Amendments to the Disability Act

According to the Ministry of Welfare, the State Commission of Doctors for Expertise of Health and Labour Capacity will have the right to extend the previously established group of disability in the period of time when the person has submitted an application for re-examination of disability, but the application is still pending or in the process of consideration and the Commission’s decision has not yet taken place.

Amendments to the Disability Act

This is stipulated in the draft law ÂŤOn Amendments to the Act on Disabled PersonsÂť, which was adopted at a government meeting on Tuesday, 6 December. It has yet to be considered and passed by the Sejm.

The bill will address a problematic situation where the number of applications has increased dramatically, potentially attributed to the socio-economic crisis and the effects of the Covid-19 pandemic, and which creates risks of not receiving disability-related support services in a timely manner.

As a result of the bill, there will be no interruption in disability status and receipt of disability pension, benefits and social services for persons who have applied for reexamination of disability in time, i.e. the period of incapacity for work.
